Power Go Big User Agreement

1.1 Developer Name: Shenzhen Jiuru Technology Co., Ltd.

1.2 Power Go Big ("we"): Shenzhen Jiuru Technology Co., Ltd.

1.3 Licensed Software: refers to the software system developed by Shenzhen Jiuru Technology Co., Ltd. for you to download from the platform and install and use on a limited system mobile terminal.

1.4 Services: the services provided to you by Power Go Big. You can use the Services on a mobile terminal through the Licensed Software.

1.5 Power Go Big: refers to the registered trademark or brand name of Shenzhen Jiuru Technology Co., Ltd.

2.1 Power Go Big provides you with Power Go Big device management services. You can control smart terminals connected to the Power Go Big cloud platform through Power Go Big and achieve linkage between smart devices. The service content includes smart device management, scene linkage, analysis reports, etc. These functional services may be optimized or modified according to changes in user needs or the unilateral judgment of the service provider, and may also be temporarily stopped for regular or irregular maintenance.

3.1 Power Go Big grants you a right to use the Product in respect of the Software.

3.2 You shall not carry out any form of licensing, selling, leasing, transferring, distributing, or other commercial use of the Product.

3.3 Due to the limitations of the software adaptation platform and terminal, you may only use the Licensed Software on the authorized system platform and terminal. If you install the Licensed Software on other terminal devices, it may cause damage to the functions of your hardware or software.

3.4 You should understand that the Licensed Software can only be used for non-commercial purposes and cannot be installed, used, or run for commercial operation purposes. If such use is required, prior written authorization and permission from Power Go Big must be obtained.

3.5 Power Go Big will from time to time make changes, upgrades, or transfers to the Licensed Software and its related functions, and may add new functions or services to the Licensed Software system. If there is no separate agreement for the above new functions and services, you can still obtain the authorization for the corresponding functions and services and they are subject to this Agreement.

3.6 You shall be responsible for the accuracy, reliability, completeness, and legality of the input data and the legality of the way you obtain the data, and shall regularly back up the data, materials, etc. You shall bear all risks of damage or loss of such materials.

3.7 You shall properly keep your account and password. If you find that your account has security risks (including but not limited to the leakage of the user password), you shall promptly notify Power Go Big, and Power Go Big will assist you in taking relevant measures. Otherwise, all acts under your account shall be your responsibility, and you shall bear all responsibilities.

4.1 You are aware that part of the Services of Power Go Big may be obtained based on software or services provided by third parties. Such services are set up to provide you with convenience and are obtained with the legal authorization of the third party.

4.2 The Product contains part of the information and services of third parties. Power Go Big does not control and is not responsible for the information and services of third parties.

4.3 You understand that Power Go Big cannot guarantee that the Licensed Software will be used permanently or contain such services, nor can it guarantee whether the same third party will continue to be used for other software in the future, and may also use similar services of other third parties. Once the above corresponding software or services are enabled, this clause shall also apply.

5.1 You should use the Licensed Software in a standardized manner. The following ways are in violation of the use specifications:

1. Publishing or sharing computer viruses, worms, malicious codes, or software that intentionally damages or changes computer systems or data;
2. Collecting the information or data of other users, such as email addresses, without authorization;
3. Maliciously using the Product in an automated way, causing excessive burden on the server or otherwise interfering with or damaging the website server and network connection;
4. Attempting to access the server data or communication data of the Product without authorization;
5. Interfering with or damaging the use of the Product by other users.

5.2 You understand and agree that:

1. Power Go Big will determine whether you are suspected of violating the above use specifications and, based on the determination result, suspend or terminate the use license for you or take other restrictive measures as agreed;
2. For the information published by you when using the Licensed Software that is suspected of being illegal, infringing on the legitimate rights of others, or violating this Agreement, Power Go Big will directly delete it;
3. For any damage caused to any third party by your violation of the above use specifications, you need to independently bear legal responsibility in your own name and ensure that Power Go Big is exempt from losses or increased expenses arising therefrom. Otherwise, Power Go Big has the right to claim compensation from you;
4. If you violate the relevant laws or the provisions of this Agreement, causing any loss to Power Go Big, you shall compensate Power Go Big for the loss and/or expenses incurred thereby.

6.1 You promise not to use the Services for any illegal or improper activities, including but not limited to the following acts:

6.1.1 Uploading, transmitting, or sharing information containing any of the following contents:

1. Opposing the basic principles established by the Constitution;
2. Endangering national security, disclosing state secrets, subverting state power, and undermining national unity;
3. Damaging national honor and interests;
4. Inciting ethnic hatred, ethnic discrimination, and undermining national unity;
5. Damaging national religious policies, promoting cults, and feudal superstitions;
6. Spreading rumors, disturbing social order, and damaging social stability;
7. Spreading pornographic, erotic, gambling, violent, homicidal, terrorist, or abetting criminal content;
8. Insulting or slandering others and infringing on the legitimate rights of others;
9. Containing false, fraudulent, harmful, coercive, infringing on others' privacy, harassing, infringing, slandering, vulgar, obscene, or other morally offensive content;
10. Containing other contents restricted or prohibited by Chinese laws, regulations, rules, regulations, and any normative documents with legal effect.

7.1 Protecting your personal information is important to Power Go Big. Power Go Big has formulated the Power Go Big Platform Privacy Policy to make important disclosures on the ownership and protection of intellectual property, as well as the collection, use, sharing, storage, and protection of your information. It is recommended that you read the Power Go Big Platform Privacy Policy in its entirety.

8.1 Except as expressly provided by laws and regulations, Power Go Big will make its best efforts to ensure the security, effectiveness, accuracy, and reliability of the Licensed Software and the technology and information involved. However, limited by the existing technology, Power Go Big cannot guarantee this.

8.2 You understand that Power Go Big cannot be held responsible for your direct or indirect losses caused by force majeure and third-party reasons.

8.3 You shall bear the liability for any personal injury or incidental and consequential damages caused by or related to any of the following circumstances:

1. Unauthorized use of the Licensed Software by a third party or alteration of your data;
2. Fees and losses arising from acts performed using the Licensed Software;
3. Your misunderstanding of the Licensed Software;
4. Other losses related to the Licensed Software not caused by Power Go Big.

8.4 Any software derived from the Licensed Software that is not developed and officially released by Power Go Big or its authorized developers is illegal. Downloading, installing, or using such software may lead to unpredictable risks, and the legal liability and disputes arising therefrom are not related to Power Go Big. Power Go Big has the right to suspend or terminate the use license and/or any other services.

8.5 You are aware that using the Power Go Big platform involves Internet services and may be affected by unstable factors in various links. Although Power Go Big has taken security measures, the Services may still be suspended, interrupted, delayed, restricted, or unavailable due to the inherent defects of the Internet and electronic communications and events that neither party to this Agreement can reasonably control (including but not limited to fire, flood, terrorist attack, plague, natural disaster, riot, terminal virus, hacker attack, network failure, terminal failure). You hereby specifically assume the above risks and agree that when the actual occurrence of the above risk events affects the normal operation of the Services, Power Go Big shall not be liable to you.

9.1 You should understand that the use of the Services of Power Go Big requires the use of the Licensed Software within the authorized scope, respect for the intellectual property rights of the software and the contents contained therein, use the software in a standardized manner, and perform obligations in accordance with the terms of this Agreement. If you seriously violate this Agreement, Power Go Big will terminate the use license.

9.2 Your use of the software depends on the supporting services provided to you by the affiliated companies of Power Go Big. If you violate the relevant regulations such as the terms, agreements, rules, and notices of Power Go Big and its affiliated companies, it may result in your inability to normally use the Licensed Software, and Power Go Big has the right to terminate the use license. Or take restrictive measures against your use license and other rights and interests controlled by Power Go Big in the manner agreed in the Agreement, including suspending or terminating the use license for you.

9.3 Once you violate the provisions of this Agreement or other agreements signed with Power Go Big, Power Go Big may notify the affiliated companies of Power Go Big and require them to take restrictive measures against your rights and interests, including requiring the affiliated companies to suspend or terminate the provision of part or all of the Services to you, and publicly disclose your breach of contract on the websites they operate or actually control in accordance with the law.

9.4 The Licensed Software is obtained by you from the download platform, and you need to comply with the agreements on the way and restrictions of your use of the Licensed Software by the download platform, system platform, and terminal manufacturer. If the above third parties confirm that you have violated the agreement and require Power Go Big to process it, Power Go Big may terminate the use license for you due to the request of the third party.

9.5 When this use license is terminated, you shall stop using the Licensed Software and destroy all copies.

9.6 If you violate the terms of this Agreement and cause losses to Power Go Big or other users, you must bear all compensation responsibilities.

10.1 The validity, interpretation, modification, execution, and dispute resolution of this Agreement shall refer to the general international commercial practices and/or industry practices.
